Cum ad vim faciendam quidam armati venissent, armati contra praesto fuerunt et cuidam equiti Romano quidam ex armatis resistenti gladio manum praecidit. Agit is, cui manus praecisa est, iniuriarum. Postulat is, qui cum agitur, a praetore exceptionem: EXTRA QUAM IN REUM CAPITIS PRAEIUDICIUM FIAT.

Translation

Some armed men had come with the intent to do violence, and other armed men were ready to meet them. A Roman knight resisted and one of the armed band cut off his hand with a sword. The man whose hand had been cut off brings action for iniuriae (personal injury). The defendant claims an exception from the praetor in these words: "PROVIDED THAT PREJUDGEMENT SHALL NOT BE GIVEN AGAINST THE DEFENDANT ON A CAPITAL CHARGE".
